TERMS ON REAL ESTATE:  A 10% Buyers Premium will be added to the winning bid to determine the final contract selling price for the property. The purchaser shall make a non-refundable deposit at the conclusion of the auction in the amount of Ten Thousand Dollar ($10,000.00).  The deposit must be in the form of cash, certified check, cashier’s check, or good personal check secured by purchaser’s personal demand note.   The balance to be paid upon delivery of a General Warranty Deed according to applicable law on or before September 10th, 2018.  Possession to be given at closing and date of deed.  Time is of the essence in the purchase agreement. Taxes and HOA fee to be prorated to date of closing. Buyer will pay $150.00 to Mattingly Ford Title Services for the preliminary title exam. The property is being sold as is with no warranty.  Buyer will sign a lead based paint disclosure.  Buyer is to verify lot size, square footage, restrictions, floodplain, and taxes. Auctioneer/Broker/Seller will not be liable for this information. All risks of loss with respect to the property shall remain with SELLER until the closing and delivery of deed.  In Cooperation with eXp Realty. *Any Announcements made the day of the Auction take precedence over printed material or any other oral statements made. 

TERMS ON PERSONAL PROPERTY:  A 10% Buyers Premium will be added to the highest winning bid to determine the final selling price. A 6% sales tax will be added to the final selling price.  All items to be paid for and removed the day of the auction. Cash, Checks and Credit Cards (Master Card & Visa).  If Credit Card is used there will be a 3% Service Charge Added to the Final Bill.

The parties unconditionally agree: (a) Each lot will be sold “As Is” and “With all Faults.” (b) Bidder acknowledges that all lots were available for inspection prior to auction and, by these terms, auctioneer strongly encouraged bidder to carefully inspect each lot in which bidder had any interest to determine the lot’s nature, quality, condition, quantity, and size. (c) Bidder relied solely on personal inspection and not on information listed in the catalog, or otherwise provided by Auctioneer, its staff, or seller. (d) If bidder failed to inspect any lot, this failure to inspect, or otherwise be fully informed as to the lot’s nature, quality, condition, quantity and size will not constitute ground for any claim, adjustment, refund, termination of the contract for sale, or refusal to close the sale. (e) Auctioneer may have made oral statements about the merchandise in a lot that was purchased by a bidder and which is the subject of a contract for sale with the seller. (f) Such statements do NOT constitute warranties of any kind by the seller, shall NOT be relied upon by bidder, and are NOT part of the contract for sale. (g) The entire contract for sale is embodied in these written terms. (h) These written terms constitute the final expression of the parties’ agreement and a complete and exclusive statement of the terms of the contract for sale. (i) The IMPLIED WARRANTIES OF MERCHANTABLITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ALL OTHER WARRANTIES, EITHER EXPRESSED OR IMPLIED, ARE SPECIFICALLY EXECLUDED from this contract for sale and transaction and shall not apply to the merchandise that is subject of this sale.  Buyer purchase at buyers’ own risk.  Neither the Auctioneers, Agents, nor Sellers shall be responsible for any errors or omissions herein.  All Statements made the day of the auction by Auctioneer supersede any written or printed material.  Neither the Auctioneers, Agents, nor Sellers shall be responsible for any errors or omissions herein.  All Statements made the day of the auction by Auctioneer supersede any written or printed material.
